Ordinance on Advertisement No.39/2001/PL-UBTVQH10

Article 15. Conditions for the advertisement of business, commodity and service activities

1. Conditions for the advertisement of business, commodity and service activities are stipulated as follows:

a. Advertisements for goods that need to be inspected or certified in quality shall have to obtain certificates by the competent governmental authorities in charge of commodity quality; if the standards for commodity quality are self-announced, a written announcement shall be required; a certificate of intellectual property shall be required for commodities of intellectual property.

2. The advertiser shall have to present all necessary documents specified in Clause 1 of this Article to the advertisement service dealers or the advertisement releasing agents; the advertisement service dealers shall have to submit all necessary documents specified in Clause 1 of this Article to the advertisement releasing agents.

Article 23. Rights and obligations of the advertiser

1. The advertiser’s rights:

a. To advertise his/her business, commodity and service activities;

b. To select at their liberty the advertisement service dealer, the advertisement releasing agent, means and mode of advertisement;

c. To register for the protection of intellectual property over advertised products;

d. Other rights stipulated by laws.

2. The advertiser’s obligations:

a. To do advertise in line with the contents of the business registration certificate;

b. To insure the advertisement contents are true and exact;

c. To realize obligations specified in the contracts;

d. Other obligations stipulated by laws.

Article 24. Rights and obligations of the advertisement service dealer

1. Rights of the advertisement service dealer:

a. To select at their liberty the modes and fields for advertisement service business;

b. To request the advertiser to provide true and exact information about the advertisements;

c. To register for the protection of intellectual property over advertised products;

d. To cooperate with other organizations or individuals in advertising activities;

e. To participate with domestic and foreign advertisement associations;

f. Other rights stipulated by laws.

2. Obligations of the advertisement service dealer:

a. To strictly execute the regulations stipulated in the business registration certificate;

b. To strictly execute the laws and regulations on advertisement;

c. To fulfill all obligations agreed in the contracts on advertisement service;

d. To compensate damages caused by themselves;

e. Other obligations stipulated by laws.
