The Department of Intellectual property of the Ministry of Commerce of the Kingdom of Thailand (hereinafter referred to as "DIP") and the National Office of Intellectual Property of the Ministry of Science and Technology, the Copyright Office of the Ministry of Culture and Information, and the Market Control Department of the Ministry of Trade of the Socialist Republic of Vietnam (hereinafter referred to as "Agencies concered of Vietnam"),  (hereinafter referred to as the "Parties");

RECALLING the visit to Vietnam between 24-25 September 2003, during which Mr. Watana Muangsook, Deputy Minister of Commerce of the Kingdom of Thailand held talks with Mr. Truong Dinh Tuyen, Minister of Trade, Mr. Hoang Van Huay, Vice Minister of Science and Technology, and Mr. Le Tien Tho, Vice Minister of Culture and Information of the Socialist Republic of Vietnam;

NOTING that intellectual property has become increasingly important in economic, cultural and social development, therefore while there is a need for greater cooperation in the creation of new intellectual property as well as making uses of the existing ones for mutual benefits in economic development, there is also a need for closer cooperation to address problems of intellectual property infringement in both countries;

HAVE AGREED AS FOLLOWS:

 

Article 1

Establishment of Focal Point

Both Parties shall establish Focal Point in order to coordinate the implementation of the Memorandum of Understanding as well as to submit and to receive information, news and updates on intellectual property development from each Party:

Article 2

The Scope of Cooperation

For the purpose of promoting the positiveness of intellectual property protection system, encouraging the creation of new intellectual property assets and protecting the available intellectual property assets of Thailand and Vietnam, the cooperation may include, but not limited to, the following areas: inventions, utility models, trademarks, industrial designs, geographical indications, copyrights, related rights and the enforcement of intellectual property rights.

 

Article 3

Exchange of Information and Experiences 

With a view to assisting the administration and enforcement of intellectual property rights and to making all stakeholders deeply understand the intellectual property protection systems of Thailand and Vietnam, and thus promoting the use of these systems, both Parties agree to maintain the regular exchange of intellectual property information. Intellectual property information may include, inter alia, the following:

  • ·Intellectual property laws and regulations;
  • ·Procedures for the acquisition of intellectual property rights;
  • ·Policy and measures for the enforcement of intellectual property rights;
  • ·Infringement of intellectual property rights in the economy of each Party;
  • ·

The Parties will strengthen the exchange of experiences in all issues related to administration and enforcement of intellectual property rights in each country as well as discuss the matters of mutual concerns, in the forms of exchange of information, meetings, organization of conferences, seminars, training courses, study tours, study visits etc.

 


Article 4

Inventions and Utility Solutions

With a view to increasing the number of applications and number of patents granted to inventions and utility models of each country in the other country, the Parties agree:

Trademarks

In order to increase the number of applications and certificates granted to trademarks of each country in the other country, the Parties agree:

Article 6

Industrial Designs

In order to increase the number of applications and patents granted to industrial designs of each country in the other country, the Parties agree:

Article 7

Geographical Indications

Recognizing that both Thailand and Vietnam are well endowed with important natural resources that are attributable to geographical characteristics of products of the two countries, the Parties agree:

  • ·

 

Article 8

Copyrights and Related Rights

Recognizing that both Thailand and Vietnam are abundant in creative works that should be protected, the Parties agree to undertake the following actions:

  • ·To hold fora to discuss issues relating to the protection and enforcement of copyrights and related rights in each countries, including computer software, if necessary;
  • ·To facilitate notification of copyrights and related rights of the nationals, organizations of Thailand and Vietnam in accordance with the legislation of each countries;
  • ·

 

Article 9

Enforcement

In order to prevent the production and trading in intellectual property rights infringing goods especially cross-border trading of counterfeit goods, the Parties agree to strengthen the enforcement of intellectual property rights in each country as well as to coordinate the enforcement efforts between the two countries which include, inter alia, the following:

  • ·
  • ·Taking measures in accordance with laws and regulations of either country to handle cases when detecting intellectual property rights infringing goods or acts by traders of the other country and informing competent authorities of the other country of the infringing acts and ways of handling thereof;
  • ·Strongly supporting enterprises of either country in enforcing their intellectual property rights, ensuring the healthy and fair business environment, encouraging bilateral investment and trade;
  • ·Facilitating the efficient operation of societies, social organizations in combating counterfeit and protecting intellectual property rights in each country;

 

Article 10

Final Provisions

1. This Memorandum of Understanding shall enter into force upon signature and shall remain effective until either Party terminates this Memorandum of Understanding by giving three months written notice to the other Party of its intention to do so.

2. The provisions of this Memorandum of Understanding may be amended by mutual agreement by the parties in writing.
